Terms of Service

These Terms of Service (“Terms”) govern your use of Smida. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Smida.

1. What Smida Is
Smida is a prompt optimization tool. You provide a prompt; we use the Claude AI API (operated by Anthropic) to generate improved versions; you get better results from the AI tools you already use. That is the core service. Some features — specifically the ability to save your optimization history and purchase additional credits — require a free account.
Smida is not an AI model itself. It is a layer that structures and routes your prompts through Anthropic's Claude API. The quality of the optimized outputs depends on the Claude model and the specificity of your original prompt.
2. Your Account
To use the full service, you must create an account using a valid email address. You are responsible for keeping your login credentials secure. Do not share your account with others.
You must be at least 16 years old to create an account. By creating an account, you confirm that you meet this age requirement.
We may suspend or delete accounts that violate these Terms. If we do, we will try to notify you in advance unless the violation is severe enough that immediate action is necessary.
3. Credits and Payment
3.1 The credit system
Smida runs on a credit system. Each prompt optimization costs 1 credit. New accounts receive 3 free credits. Additional credits are purchased in packs — you pay once and the credits are added to your balance immediately.
Credits do not expire. Your balance is tied to your account and carries forward indefinitely as long as your account is active.
3.2 Payments
Payments are processed by Stripe. All purchases are one-time payments — there are no recurring subscriptions, automatic renewals, or hidden fees. The price you see is the price you pay. Payments are in the currency shown at checkout.
We do not store your card details. Payment card data is handled entirely by Stripe under their PCI-DSS compliant infrastructure.
3.3 Refunds
Because credits are digital goods delivered instantly, all sales are final. We do not offer refunds on credit pack purchases except in the following circumstances:
- You were charged but your credits were not added to your account due to a technical error on our side.
- You were charged twice for the same purchase.
If either of these apply, contact support@smida.com within 14 days of the charge with your purchase date and the email address used, and we will make it right.
4. Acceptable Use
You may use Smida for any lawful purpose. You may not use it to:
- Generate or optimize prompts designed to produce illegal content, including child sexual abuse material (CSAM), content that incites violence, or content that facilitates fraud.
- Attempt to extract, reproduce, or reverse-engineer the underlying system prompts, optimization logic, or AI model weights used by Smida.
- Scrape, crawl, or use automated means to access Smida at scale without our written permission.
- Resell or commercially redistribute optimized outputs as a prompt optimization service competing with Smida.
- Violate any applicable law or regulation, including data protection laws, export controls, or intellectual property laws.
- Submit prompts that contain other people's personal data, passwords, private credentials, or confidential information belonging to a third party without their authorization.
Violation of these rules may result in immediate account suspension without refund.
5. The Service and AI Output
5.1 No guarantees on output quality
Smida improves prompts — it does not guarantee any specific outcome when you use those prompts in other AI tools. The optimized prompt is a suggestion based on our AI's interpretation of your input. Results will vary depending on the AI tool you use, the task, and factors outside our control.
5.2 AI output is not professional advice
Nothing produced by Smida — whether an optimized prompt or the output of that prompt in another AI tool — constitutes legal, medical, financial, or professional advice of any kind. Do not use AI-generated content as a substitute for qualified professional guidance on matters where that matters.
5.3 Service availability
We aim for high availability but do not guarantee uninterrupted access to Smida. The service depends on third-party infrastructure (Anthropic API, Supabase, Vercel, Stripe) that can experience outages independently of us. We are not liable for downtime caused by third-party failures.
Planned maintenance will be announced in advance where practical.
6. Intellectual Property
6.1 Your prompts
You own the prompts you submit. By submitting a prompt, you grant Smida a limited, non-exclusive license to process that prompt through our system solely for the purpose of generating the optimized output for you. We do not claim ownership over your prompts or the optimized results we return to you.
6.2 Smida's IP
The Smida product — including the application code, optimization logic, system prompts, UI, and branding — is our intellectual property. You may not copy, reproduce, or create derivative works from any part of the Smida product without our written permission.
6.3 Optimized outputs
The optimized prompts we return to you are yours to use however you like — commercially or otherwise. We make no claim on outputs generated for you.
7. Account Termination
7.1 You can leave at any time
You can delete your account at any time from your account settings. Deletion removes your personal data and optimization history within 30 days. Purchase records are retained for 7 years as required for accounting and tax compliance. Unused credits are forfeited upon account deletion — they cannot be refunded.
7.2 We may terminate accounts
We reserve the right to suspend or terminate your account if you violate these Terms, if we detect fraudulent activity, or if required to do so by law. We will give notice where reasonably practical before taking action, except in cases of severe or illegal misuse where immediate action is necessary.
If we terminate your account for reasons other than your violation of these Terms, we will refund any unused credits on a pro-rata basis.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Smida is provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We are not liable for:
- Indirect, incidental, special, consequential, or punitive damages arising from your use of Smida.
- Loss of profits, revenue, data, or goodwill.
- Damages resulting from errors, omissions, or inaccuracies in AI-generated outputs.
- Damages resulting from service interruptions or third-party failures.
Our total aggregate liability to you for any claim arising from your use of Smida is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or €100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. If you are in such a jurisdiction, the above limitations apply to the fullest extent permitted by local law.
9. Disputes
If you have a dispute with us, please contact support@smida.com first. We genuinely want to resolve issues directly before they escalate.
These Terms are governed by Swedish law. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Sweden. If you are a consumer in the EU, you may also have the right to submit a complaint to the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
10. Changes to These Terms
We may update these Terms from time to time. If we make a material change — one that significantly affects your rights or obligations — we will notify you by email at least 14 days before the change takes effect. Your continued use of Smida after that date constitutes acceptance of the updated Terms.
Minor clarifications (fixing typos, improving clarity without changing meaning) may be made without notice. The current version is always available at smida.com/terms.
11. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smida regarding use of the service.
- Severability: If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force.
- No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer your account or rights under these Terms without our written consent. We may assign our rights and obligations under these Terms to a successor in the event of a merger, acquisition, or sale of assets, with notice to you.
- Language: These Terms are written in English. Any translated versions are provided for convenience only; the English version controls in the event of a conflict.
